(OMAHA WORLD-HERALD) The Omaha World-Herald reports, "A federal judge has again dismissed a claim in which Niobrara River irrigators said their rights were violated when the state limited their use of water from the river.
U.S. District Judge Lyle Strom ruled in a lawsuit brought by several landowners challenging the Nebraska water czar's order three years ago to shut off their irrigation pumps. They said the action violated their constitutional right by depriving them of their property without a hearing.
Strom wrote in his opinion: 'The plaintiffs did not have a property right to be free from (Nebraska Natural Resources Department) regulation . . . .'"
