(KEARNEY HUB) The Kearney Hub reports "Central Nebraska Public Power and Irrigation District has gone back to the Nebraska Supreme Court on another quest to challenge decisions made by the North Platte Natural Resources District board of directors regarding the district's operations. CNPPID attorney Mike Klein reported to the CNPPID board at its September meeting that he has filed a motion for reconsideration with the Nebraska Supreme Court, after it, last month, rejected CNPPID's claim that it should be allowed to appeal the North Platte Natural Resources District board's limits on groundwater irrigators along the small creek.
In August, the court ruled that CNPPID does not have standing to appeal a decision by the NPNRD board. The judges said CNPPID could not challenge NPNRD's decision based upon the interests of Central's constituents, such as irrigators and recreationists at Lake McConaughy. Central had appealed the NPNRD's decision, claiming the allocation did nothing to restore flows to the creek, which flows into the North Platte River near Bridgeport. Klein had argued that the loss of the creek's inflow, about 23,000 acre-feet a year, hampered CNPPID's irrigation deliveries and power generation, as well as public recreation connected with Lake McConaughy, CNPPID's storage facility."
